General Terms and Conditions

1. General Terms

If the Client wants to add additional services after the contract has been concluded, SPACE 4 TIME issues a separate quote. The Parties may also initiate negotiations for a contract amendment.

SPACE 4 TIME reserves the right to decline any service if the information provided by the Client is inaccurate or incomplete. Specifically, SPACE 4 TIME may refuse to transport heavy items that exceed the expected weight for such items, or provide any additional services if the fulfillment of such services is deemed too burdensome based on the actual circumstances. The Client acknowledges and agrees that the accuracy and completeness of the information they provide are critical for the proper execution of the services requested.

If any item to be transported is large and can be reasonably disassembled into parts, the Client is required to disassemble the item prior to the transport. The Client acknowledges that failure to do so may result in additional charges or refusal of the additional transport service. The Client is responsible for ensuring that all parts are securely packaged and labeled to facilitate safe and efficient transport.

2. Deposit and Payment

2.1. The Client pays a 50 GBP deposit via bank transfer or Revolut at the time of the conclusion of the contract.

2.2. The deposit is non-refundable if the order is canceled less than 7 days prior to the scheduled date.

2.3 The payment is due in two installments. The first installment is due 7 days before the collection date, and the second installment is due on the day of delivery, upon the vehicle’s arrival at the delivery location. Each installment is in the amount of 1587.50 GBP.

2.4. If the Client picks a method of payment, including a Third Party provider of payment services, the Client may be obliged by the regulations and conditions and/or taxes of such a Third Party.

2.5. SPACE 4 TIME is not liable if a certain method of payment, including a Third Party provider of payment services, is not available or in other aspects is not working due to reasons, for which SPACE 4 TIME can’t be held accountable for.

3. Inventory List, Consignment Note Procedures and Customs Clearance

3.1. The Client is required to provide a finalized inventory list no later than one week prior to the scheduled collection date. If the inventory list reveals that the cargo exceeds the agreed-upon limits, SPACE 4 TIME will promptly notify the Client.

3.2. The Client must verify all items against the inventory list at both the loading and unloading locations to ensure accuracy.

3.3. After all items have been accounted for, both SPACE 4 TIME and the Client must sign the inventory list. The Client must use SPACE 4 TIME’s official inventory list form, as handwritten inventory lists will not be accepted.

3.4. The Client can submit a claim within one week from the date of receipt of the items.

3.5. Under no circumstances will SPACE 4 TIME be held liable if the signed inventory list is missing or not duly provided, and the Consignment Note under CMR has not been signed.

3.6. SPACE 4 TIME will provide the Client with the customs clearance documents once the transport has been confirmed. The Client is required to submit all necessary customs paperwork no later than two weeks prior to the scheduled collection date. If the transport is reserved within two weeks of the collection date, the paperwork must be submitted immediately following the reservation. In case of any delays or incorrect filling out of the paperwork or missing documents, it’s the Client’s responsibility to pay V AT, duty taxes and/or any additional fees for the used goods for which duty-free entry was requested.

4. Fragile Items and Electronics

4.1. Client shall follow the instructions for packing and labeling, as follows:

  • Furniture, such as sofas and beds must be wrapped with bubble wrap;
  • Fragile items, glass items and kitchenware must be wrapped and boxed;
  • Clothes, shoes, duvets, etc must be boxed or put in bags;
  • Mattresses must be covered with special cover for mattress or bubble wrap;
  • Electronics must be wrapped and boxed with original or special suitable box.

4.2. The Client is responsible for adhering to the packing and labeling rules provided by SPACE 4 TIME. Failure to comply with these instructions will result in the Client being liable for any damages that occur as a result.

4.3. While SPACE 4 TIME takes every precaution to protect the Client’s belongings, damages may still occur. Upon delivery, the Client must inspect all items before signing the CMR Consignment Note. If any damages are found, the Client must immediately contact SPACE 4 TIME and note the damages on the CMR Consignment Note. The Client should only sign the CMR Consignment Note after all items have been unloaded and accounted for.

4.4. It is the Client’s responsibility to take photographs of the packed fragile items and send them to space4timeremovals@gmail.com for review prior to the move.

5. Additional Requirements

5.1. EXHIBIT A: CLIENT RESPONSIBILITIES forms part of this Contract and specifies further the responsibilities of the Client.

5.2. Client must follow the instructions listed in EXHIBIT A, including but not limited to forbidden products, filling out of paperwork, weight and volume requirements, loading/unloading requirements, parking requirements, packing requirements, insurance, etc.

6. Time for Delivery

6.1. While it is not anticipated that drivers will be late for collection or delivery, occasional delays may occur due to the long distances they travel. In such instances, you will be notified in advance. SPACE 4 TIME does not offer compensation for late collection or delivery.

6.2. SPACE 4 TIME is not liable for any delays resulting from circumstances beyond our control. This includes, but is not limited to, traffic conditions, weather events, or other unforeseen situations.

6.3. If the removal service is scheduled with a flexible collection date and SPACE 4 TIME does not receive confirmation from the Client regarding the acceptance of the proposed collection date, SPACE 4 TIME cannot be held liable for non-performance of the contract.

7. Loading and Unloading the Vehicle

7.1. Unless otherwise agreed in the contract, the Client is responsible for providing assistance in loading and unloading the vehicle(s). If such assistance is not provided, additional payment may be required depending on the amount of work required. The Client will be responsible for all additional loading charges in cases where the self-loading service is not possible.

7.2. The agreed upon price for the removal service is predicated on unimpeded access to and from the Client’s premises. Should access be in any way obstructed or hindered at either location, the Client is obliged to notify SPACE 4 TIME in advance to facilitate the arrangement of appropriate equipment or supplementary assistance. Non-compliance with this requirement will render the Client liable for any extra costs accrued on the day of loading or unloading. SPACE 4 TIME reserves the right to terminate the contract if the service cannot be performed due to restricted access.

7.3. Obstructed or hindered access, as used in this clause, includes but is not limited to instances such as narrow staircases, conditions necessitating the deployment of additional personnel or equipment, and sites where vehicles are unable to fit, leading to extended carrying distances.

7.4. SPACE 4 TIME is not liable for any damage or loss due to handling, loading, stowage or unloading of the goods by the sender, the consignee or person acting on behalf of either of them.

8. Services Exceeding the Quote

8.1. By “vehicle overload,” we refer to any items or cargo that exceed the original quote and price provided by SPACE 4 TIME and are not specified in the concluded contract.

8.2. The Client is obligated to provide an accurate description of the cargo, including its volume, weight, and item details.

8.3. If the Client exceeds the agreed-upon limits for volume, weight, or other service specifications, SPACE 4 TIME reserves the right to either execute the order as originally specified or issue a new offer at a price based on the circumstances.

8.4. The Client has the right to accept the new offer, in which case they must make the payment immediately.

8.5. If the Client does not accept the new offer or refuses to make the payment immediately, the order will be considered canceled. In such cases, the cancellation rules outlined in the terms will apply.

8.6. SPACE 4 TIME can use photographs of the vehicle and/or scale results and/or scale notes as valid evidence to establish any overloading of the cargo.

9. Liability

9.1. When, under the provisions of this Contract, SPACE 4 TIME is liable for compensation in respect of total or partial loss of goods, such compensation shall be calculated by reference to the value of the goods at the place and time at which they were accepted for carriage.

9.2. The value of the goods shall be fixed according to the commodity exchange price or, if there is no such price, according to the current market price or, if there is no commodity exchange price or current market price, by reference to normal value of goods of the same kind and quality.

9.3. In addition, the carriage charges, Customs duties and other charges incurred in respect of the carriage of the goods shall be refunded in full in case of total loss and in proportion to the loss sustained in case of partial loss, but no further damage shall be payable.

9.4. In the case of delay if the claimant proves that damage has resulted therefrom the carrier shall pay compensation for such damage not exceeding the carriage charges.

9.5. Higher compensation may only be claimed where the value of the goods or a special interest in delivery has been explicitly declared.

9.6. The sender may, against payment of a surcharge to be agreed upon, declare in the consignment note a value for the goods exceeding the limit laid down in article 9.3., and in that case the amount of the declared value shall be substituted for that limit.

9.7. In case of damage, the carrier shall be liable for the amount by which the goods have diminished in value, calculated by reference to the value of the goods fixed in accordance with article 9.1, 9.2 and 9.4

9.8. The compensation may not, however, exceed:
a) If the whole consignment has been damaged, the amount payable in the case of total loss;
b) If part only of the consignment has been damaged, the amount payable in the case of loss of the part affected.

10. Cancellation of Contract

10.1. The Client can cancel the Contract at any time before its execution begins.

10.2. If costs have been incurred by SPACE 4 TIME in connection with the performance of the contract and the Client cancels the contract, SPACE 4 TIME reserves the right to withhold the appropriate amount of these costs or to claim their payment from the Client.

10.3. SPACE 4 TIME has the right to retain any transaction fees in the event of a cancellation that is not attributable to their own fault.

10.4. The Client receives a full refund of the paid service price where the cancellation of the contract is made one week or more before the collection date.

10.5. The Client pays 25% of the service price as a cancellation fee where the cancellation of the contract is made less than 7 days and more than 3 days before the collection date.

10.6. The Client pays 50% of the service price as a cancellation fee where the cancellation of the contract is made less than 3 days before the collection date.

10.7. The cancellation fee is based on the incurred expenses for SPACE 4 TIME and its subcontractors. The cancellation fee is not a penalty.

11. Complaints

11.1. The Client has the right to file a complaint regarding any non-conformity of the service with the contract. Complaints can be made in writing to the specified email address or to the company’s address.

11.2. If the consignee takes delivery of the goods without duly checking their condition with the carrier or without sending him reservations giving a general indication of the loss or damage, not later than the time of delivery in the case of apparent loss or damage and within seven days of delivery, Sundays and public holidays excepted, in the case of loss or damage which is not apparent, the fact of this taking delivery shall be prima facie evidence that he has received the goods in the condition described in the consignment note. In the case of loss or damage which is not apparent the reservations referred to shall be made in writing.

11.3. When the condition of the goods has been duly checked by the consignee and the carrier, evidence contradicting the result of this checking shall only be admissible in the case of loss or damage which is not apparent and provided that the consignee has duly sent reservations in writing to the carrier within seven days, Sundays and public holidays excepted, from the date of checking.

11.4. No compensation shall be payable for delay in delivery unless a reservation has been sent in writing to SPACE 4 TIME.

11.5. When filing a complaint, the Client should specify the nature of the claim, the preferred resolution, the amount claimed, and provide contact details including address, telephone, and email.

11.6. The Client must attach supporting documents to the complaint, such as a receipt or invoice, written statements, memoranda, or other documents demonstrating the lack of conformity of the goods or services with the agreed terms. Additional documents establishing the grounds and amount of the claim should also be included.

11.7. When SPACE 4 TIME resolves a complaint, it will issue a document in two copies, providing one copy to the Client.

12. Intellectual Property

12.1. The rights of intellectual property over materials and resources, placed on the website of SPACE 4 TIME (including the existing database), that are an object of protection under the Law on Copyright and Neighbouring Rights, are property of SPACE 4 TIME or the indicated person, who transferred the right of use to SPACE 4 TIME and can not be used in violation of the current legislation.

12.2. When copying or reproducing information beyond the legal limits or by any other violation of intellectual property rights on the resources of SPACE 4 TIME, SPACE 4 TIME has the right to make a claim for all damages including direct and indirect damages.

12.3. Except as expressly agreed upon, the Client may not reproduce, modify, delete, publish, distribute or otherwise disclose the information resources posted on the SPACE 4 TIME website.

12.4. SPACE 4 TIME has the right, but not an obligation, at its discretion to delete information resources and materials posted on their site.

13. Communication and Digital Signatures

13.1. Both Parties acknowledge the legal validity of the digital signatures. All contracts and documents signed in such a manner are legally binding for the parties.

13.2. The Parties recognise the Clients’ e-mail address and phone number as the official means of communication and will communicate important information in this manner. The Parties further agree that any notices or information transmitted via email shall be deemed as being in written form.

14. Severability Clause

14.1. The parties declare that if any of the provisions of these Terms of service prove to be invalid, this will not invalidate the entire contract or any of its parts. The invalid clause will be replaced by the mandatory rules of the law or established practice.

15. Applicable Law

15.1. The provisions of the law of the Republic of Bulgaria and the CONVENTION ON THE CONTRACT FOR THE INTERNATIONAL CARRIAGE OF GOODS BY ROAD (CMR) shall apply to any cases not governed under this Contract. Any dispute arising from this contract shall be resolved in the competent Bulgarian court.


EXHIBIT A: CLIENT RESPONSIBILITIES

EXHIBIT TO TRANSPORT CONTRACT BETWEEN SPACE 4 TIME AND CLIENT

1. CUSTOMS REQUIREMENTS

a. PROHIBITED PRODUCTS

Products subject to special customs formalities include food (any type), beverages, certain liquids containing alcohol or hazardous substances, poisonous liquids, paintings/arts, pets, plants (without certificate), phytosanitary items, medicines, alcohol, dual-use goods, weapons, drugs, waste, electric bikes, and species protected by the Washington Convention.

  • Client must pack toiletries properly to avoid damage to other items.
  • It is the Client’s responsibility if forbidden products are loaded without the removal company’s knowledge.

b. CUSTOMS CLEARANCE

Customs clearance is included in the offer.

  • Clients must send all required customs paperwork 2 weeks in advance.
  • The Client is responsible for any VAT, duty taxes, or additional fees due to delays, incorrect paperwork, or missing documents. Any fees incurred due to the Client’s failure to provide accurate and timely information will be the Client’s responsibility.

2. VEHICLE REGISTRATION

Clients must inform the transport company if they need to register a car and provide all necessary documentation a month in advance.

3. WEIGHT AND VOLUME REQUIREMENTS

a. GENERAL LIMITS

  • The total weight must not exceed 1000 kg for a Luton 20 m³ van (800 kg for Austria, Norway, and Switzerland) and 4000 kg for a 7.5 t truck.
  • Partial service (shared transport) ranges from 150 kg to 750 kg. 7.5-ton trucks are not applicable to Austria, Norway, and Switzerland.
  • Clients must inform SPACE 4 TIME if the weight exceeds 1000 kg or the volume exceeds 20 m³ for a Luton van, or if it exceeds 48 m³ or 4000 kg for a 7.5 t truck.

b. SHARED TRANSPORTATION

  • For shared transport SPACE 4 TIME can provide service from 150 kg to 750 kg, depending on the request.
  • Clients must ensure the permissible weight and volume for shared transport are not exceeded.
  • If there is any overloading, the Client is responsible for any problems, including police control and fines.

4. LOADING/UNLOADING REQUIREMENTS

a. ASSISTANCE

  • SPACE 4 TIME provides assistance to the driver from/to the ground floor. Clients must help or find someone to assist if extra help is not requested.
  • Clients must inform SPACE 4 TIME a week in advance if extra helpers are needed.

b. CONDITIONS

  • Clients must inform SPACE 4 TIME at least 7 days before the loading date about any upper floors, elevator details, narrow or spiral stairs, or other obstacles that may affect the loading/unloading process.
  • Clients must notify SPACE 4 TIME if an external lift or special equipment is needed for heavy items like pianos.

5. PARKING REQUIREMENTS

  • It is the Client’s responsibility to secure a parking space for loading/unloading.
  • Any fines due to unsecured parking are the Client’s responsibility.

6. PACKING REQUIREMENTS

a. GENERAL PACKING

  • All items must be properly packed to avoid damage. This includes furniture, sofas, beds, mattresses, small personal items, and fragile/valuable items.
  • If packing services are not required, the Client is responsible for proper packing.

b. PACKAGING MATERIALS

  • Clients should use appropriate materials, such as original TV boxes for TVs, special covers for mattresses, and bubble wrap for large furniture and fragile items.
  • Large and heavy items must be disassembled and prepared for loading unless disassembly services are requested.

c. LOADING DELAYS

  • Clients must ensure items are prepared for loading before the agreed time. Delays due to unprepared items are the Client’s responsibility, including any detention fines.

7. TRANSPORT COMPANY’S ESTIMATION AND HELP

  • SPACE 4 TIME offers assistance in determining the volume and weight of items based on descriptions, photos, and videos.
  • Final weight estimates can only be made in person.
